Acceptance of Terms
By installing, accessing, or using Gift Card Hero ("the Service"), you agree to be bound by these Terms of Service. If you are using the Service on behalf of a business, you represent that you have authority to bind that entity to these terms. If you do not agree to these terms, you must not use the Service.
Description of Service
Gift Card Hero is a Shopify application operated by Syncube that enables merchants to create, sell, and manage digital gift cards, store credit wallets, and loyalty features. The Service integrates with your Shopify store and is subject to Shopify's own terms of service and API usage policies. Features and availability may vary by subscription plan.
Account Registration
To use Gift Card Hero, you must have an active Shopify store and install the app through the Shopify App Store. You are responsible for maintaining the security of your Shopify account credentials and for all activity that occurs through your account. You agree to notify us immediately of any unauthorized access or use of your account.
Acceptable Use
You agree to use Gift Card Hero only for lawful purposes and in accordance with these terms. You may not use the Service to distribute malware, engage in fraud, violate any applicable laws or regulations, or infringe on the rights of others. We reserve the right to suspend or terminate accounts that violate this policy without prior notice.
Intellectual Property
All content, features, and functionality of Gift Card Hero - including but not limited to software, text, graphics, logos, and documentation - are the exclusive property of Syncube and are protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for your business purposes as long as your subscription is active.
Payment Terms
Paid plans are billed monthly or annually through the Shopify billing system. All fees are non-refundable except as required by applicable law. If you upgrade your plan mid-cycle, you will be charged a prorated amount for the remainder of the billing period. Syncube reserves the right to change pricing with 30 days' prior notice to active subscribers.
Limitation of Liability
To the maximum extent permitted by law, Syncube shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of Gift Card Hero. Our total cumulative liability for any claims related to the Service shall not exceed the amount you paid to Syncube in the twelve months preceding the claim. This limitation applies regardless of the theory of liability.
Disclaimers
Gift Card Hero is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Syncube does not warrant that the Service will be uninterrupted, error-free, or completely secure. You use the Service at your own risk.
Termination
You may terminate your use of Gift Card Hero at any time by uninstalling the app from your Shopify store. Syncube may suspend or terminate your access to the Service at any time for violation of these terms or for any other reason with reasonable notice. Upon termination, your right to use the Service ceases immediately, though provisions that by their nature should survive will remain in effect.
Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising under these terms shall be resolved exclusively in the state or federal courts located in Travis County, Texas. You consent to the personal jurisdiction of such courts.
Changes to These Terms
Syncube reserves the right to modify these Terms of Service at any time. We will provide notice of material changes by posting the updated terms within the app and updating the "Last Updated" date. Your continued use of Gift Card Hero after changes take effect constitutes your acceptance of the revised terms. If you do not agree to the updated terms, you must stop using the Service.
